Terms of Service

NovaBerry ("we", "us") is an independent game studio run by an individual developer. By downloading or playing a NovaBerry game, or using this website, you agree to these terms. If you are under the age of majority where you live, please review these terms with a parent or guardian.

For games downloaded from the App Store, these terms apply in addition to Apple's Standard License Agreement (EULA). If the two conflict, Apple's EULA prevails.

We grant you a personal, non-exclusive, non-transferable, revocable license to use our games for your own non-commercial entertainment, on devices you own or control, in line with the App Store's usage rules. You may not sell, rent, sublicense or redistribute our games.

Our games may offer two kinds of in-app purchases: consumable items, such as in-game currency, and one-time purchases that unlock a permanent feature, such as removing ads.

Virtual items and in-game currency have no real-world monetary value and cannot be exchanged for cash. They are licensed to you, not sold, and are only usable within the game. We may modify, rebalance or remove virtual items as the game evolves. This does not take away a feature you paid to unlock permanently; you can restore those purchases with Restore Purchases in the game's settings.

Game progress and unspent in-game currency are stored on your device. Deleting the game removes them, and we cannot restore them.

All payments are processed by Apple, and refund requests are handled by Apple under its policies: see how to request a refund. If a game is discontinued, we will try to give reasonable notice where possible.

Our games are free to play and display ads from third-party ad networks. Those ads are provided by third parties, and we are not responsible for their content or for the products they promote. Buying ad removal may not remove optional ads that you choose to watch for a reward.

You agree not to:

• cheat, hack or use unauthorized tools to modify gameplay;
• reverse engineer, decompile or extract source code or assets, except where the law expressly allows it;
• interfere with the games, their servers or other players;
• use our games or website for any unlawful purpose.

Our games, including their code, artwork, audio and design, as well as the NovaBerry name and logos, are owned by NovaBerry or its licensors and protected by intellectual property laws. Nothing in these terms transfers ownership to you.

If you send us feedback, ideas or suggestions, we may use them freely to improve our games, without any obligation or payment to you.

Our games and website are provided "as is" and "as available", without warranties of any kind. We do not guarantee that they will be uninterrupted or error-free, or that progress will never be lost.

To the maximum extent permitted by law, NovaBerry is not liable for any indirect, incidental or consequential damages, and our total liability to you will not exceed the amount you paid for our games and in-app purchases in the 12 months before the claim.

Nothing in these terms limits liability that cannot be limited by law, such as for fraud or gross negligence, or rights you have under applicable consumer protection laws.

We may suspend or end your access to our games if you break these terms. You can stop using our games at any time by deleting them from your device. Sections that by their nature should survive termination (such as intellectual property and limitation of liability) will continue to apply.

These terms are governed by the laws of the country where the developer of NovaBerry resides, without regard to conflict-of-law principles.

If you have a concern or dispute, please contact us first so we can try to resolve it informally. Nothing in these terms takes away any rights you have under the mandatory consumer protection laws of your country of residence.

We may update these terms from time to time. When we do, we will change the "Last updated" date at the top of this page. For significant changes, we will give notice through the website or in-game where possible. Continuing to play after changes take effect means you accept the updated terms.
